Verifikitchen Terms of Use

These Terms of Use (“Terms”) govern access to and use of the Verifikitchen platform and website (“Verifikitchen,” “VK,” “we,” “our,” or “us”).
By creating an account or using Verifikitchen, you agree to these Terms.
1. Purpose of Verifikitchen
Verifikitchen provides a platform designed to help food operators:
- Document commissary kitchen usage
- Record and share food sales locations
- Improve transparency between operators and health departments
- Increase public awareness of where food products are available
Verifikitchen is an informational and documentation platform. It does not issue permits, licenses, or regulatory approvals.
2. Eligibility
Users of Verifikitchen must:
- Be at least 18 years of age
- Provide accurate information when registering
- Operate a food-related business or activity consistent with applicable laws
Users remain responsible for complying with all local, state, and federal food safety laws and regulations.
3. User Accounts
Certain features of Verifikitchen require users to create an account.
Users agree to:
- Provide accurate registration information
- Maintain the confidentiality of login credentials
- Notify Verifikitchen of unauthorized account use
Users are responsible for all activity conducted under their account.
4. Information Submitted by Users
Users may submit operational information including:
- Business name and contact information
- Commissary kitchen affiliation
- Commissary check-in and check-out records
- Locations where food products will be sold
- Dates and times associated with those locations
Users are responsible for ensuring that all information submitted is accurate and current.
Verifikitchen does not independently verify all information submitted by users.
5. Sharing Information with Health Departments
Verifikitchen is intended to support transparency between food operators and regulatory agencies.
Certain information submitted through the platform may be accessible to local or state health departments or other regulatory authorities, including:
- Reported sales locations
- Dates and times of food sales activity
- Commissary kitchen usage records when applicable
This information may be used by health departments to assist with verifying compliance with applicable food safety regulations.
Additional information regarding regulatory access to platform data is described in Section 15 (Data Use & Regulatory Access) below.
6. Public Listings
Users may choose to make certain information publicly visible, including:
- Business name
- Selling locations
- Dates and times of sales activity
- Food offerings or descriptions
Users may also choose to keep selling locations private from the public.
However, certain information may still be accessible to regulatory authorities when necessary for compliance purposes.
7. User Responsibilities
Users agree not to:
- Provide false or misleading information
- Misrepresent business operations
- Use Verifikitchen to evade regulatory requirements
- Interfere with or disrupt the operation of the platform
Verifikitchen reserves the right to suspend or terminate accounts that violate these Terms.
8. Platform Availability
Verifikitchen strives to provide reliable service but does not guarantee uninterrupted access.
The platform may occasionally be unavailable due to:
- Maintenance
- Technical issues
- System upgrades
Verifikitchen is not responsible for temporary interruptions in service.
9. Limitation of Liability
Verifikitchen provides its services “as is” and makes no guarantees regarding:
- Regulatory compliance
- Health department decisions
- Accuracy of third-party or user-provided information
Users remain responsible for complying with all applicable laws and regulations.
To the maximum extent permitted by law, Verifikitchen is not liable for damages resulting from use of the platform.
10. No Regulatory Reliance
Verifikitchen provides documentation and informational tools only.
Regulatory authorities, inspectors, and agencies should not rely solely on Verifikitchen records to determine compliance with food safety regulations.
Official inspections, enforcement decisions, and regulatory determinations remain the responsibility of the applicable government authority.
10A. No Warranty of Compliance
Use of Verifikitchen does not guarantee compliance with any local, state, or federal laws or regulations.
While the platform may assist users in documenting commissary kitchen usage, reporting sales locations, or organizing operational information, Verifikitchen does not verify regulatory compliance and does not provide legal or regulatory advice.
Users remain solely responsible for understanding and complying with all applicable food safety laws, licensing requirements, and health department regulations.
Health departments and regulatory authorities maintain full responsibility for inspections, enforcement actions, and determinations of compliance.
11. Intellectual Property
All Verifikitchen platform content, software, and design elements are the property of Verifikitchen unless otherwise stated.
Users may not copy, reproduce, distribute, or modify platform content without permission.
12. Acceptable Use
Users may not use Verifikitchen to:
- Upload harmful code or malicious software
- Attempt to gain unauthorized access to the platform
- Interfere with platform security or functionality
Violation of this section may result in account suspension or termination.
13. Account Suspension or Termination
Verifikitchen reserves the right to suspend or terminate accounts that:
- Violate these Terms
- Provide false information
- Misuse the platform
Users may discontinue use of Verifikitchen at any time.
14. Changes to the Platform or Terms
Verifikitchen may modify platform features at any time.
We may also update these Terms periodically. Updated Terms will be posted on the Verifikitchen website.
Continued use of the platform after updates constitutes acceptance of the revised Terms.
15. Data Use & Regulatory Access
Verifikitchen collects information to support its platform services and improve transparency between food operators and regulatory authorities.
Health departments or other regulatory authorities may be able to access certain information submitted by users, including:
- Business name and operator information
- Reported food sales locations
- Dates and times associated with those locations
- Commissary kitchen usage records
- Related activity logs generated through the platform
This information may be used by health departments to assist with verifying compliance with applicable food safety regulations.
Users may choose to make certain selling locations publicly visible in order to promote their business.
Users may also choose to keep selling locations private from the public. However, regulatory authorities may still have access to information related to food sales locations and commissary activity when necessary for compliance purposes.
Verifikitchen provides informational records only and does not make regulatory determinations or enforce compliance requirements.
Users remain responsible for ensuring that all information submitted to the platform is accurate and current.
16. Third-Party Links and Services
Verifikitchen may contain links to third-party websites, services, or resources. These are provided for convenience only.
Verifikitchen does not control or endorse third-party services and is not responsible for their content, privacy practices, or operations.
Users access third-party services at their own risk.
17. Indemnification
Users agree to indemnify and hold harmless Verifikitchen, its owners, officers, and affiliates from any claims, damages, liabilities, or expenses arising from:
- User-provided information
- Misrepresentation of business activities
- Violations of applicable laws or regulations
- Misuse of the platform
18. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the state in which Verifikitchen services are being utilized, without regard to conflict of law principles.
